Affiliate program
Affiliate Terms & Confidentiality Agreement.
These are the working program terms for the Fire & Ash Affiliate Program. The final attorney-approved affiliate agreement signed during enrollment will control if it differs from this page.
Program summary: standard commission starts at 2% of the final qualifying cart purchase price, referral credit is established by the buyer's submitted affiliate code, and earned commissions are paid by wire within 7 days after the invoice is paid and delivery is completed.
1. Eligibility
The Fire & Ash Affiliate Program is open to individuals and businesses that are legally able to enter into a binding agreement and whose participation is consistent with applicable law and Fire & Ash brand standards.
Fire & Ash may accept, decline, suspend, or remove an affiliate at its discretion, including for fraud, misrepresentation, spam, misuse of the brand, poor-quality referrals, or conduct that could harm Fire & Ash or its customers.
Participation is non-exclusive. Affiliates are not employees, agents, franchisees, dealers, or authorized representatives of Fire & Ash.
2. Qualified referrals
A qualified referral is a legitimate prospective customer with a genuine potential need for a Fire & Ash cart and sufficient contact information for Fire & Ash to follow up.
Referral credit is established when the buyer submits the affiliate's code as part of the purchase process.
A prospect who previously expressed interest but has not placed an order may still qualify as a referral. Fire & Ash ownership makes the final determination when an existing or disputed lead is involved.
Fire & Ash may reject referrals that are fraudulent, incomplete, duplicated, unqualified, or submitted without a reasonable basis to believe the prospect has genuine interest.
3. Commission structure
The standard affiliate commission is 2% of the final purchase price of a qualifying Fire & Ash cart sale, including approved upgrades.
Commission is calculated on the final customer purchase price after any approved discounts. Sales tax, shipping, financing charges, and other pass-through charges are excluded unless Fire & Ash expressly states otherwise in writing.
Fire & Ash may introduce different commission rates or volume-based tiers in the future. Any change applies prospectively and will be communicated before it affects future referrals.
4. Referral ownership
The affiliate code submitted by the buyer establishes referral ownership.
Once properly credited, the affiliate remains tied to that lead for future qualifying purchases while the affiliate remains active in the program.
If multiple affiliates claim the same opportunity, Fire & Ash ownership makes the final determination based on the earliest valid affiliate-code attribution and available records.
If an affiliate leaves or is removed from the program, no future commissions accrue to that affiliate after the effective date of departure or removal.
5. Existing leads
A prospect already known to Fire & Ash may still qualify if the prospect has not previously placed an order and is not being actively worked as a current sales opportunity.
This can include older inquiries, prior interest, prospects that stopped responding, or other cold leads.
Fire & Ash ownership has final authority to determine whether an existing lead is eligible for affiliate credit.
6. When commission is earned
A commission is earned only after both of the following have occurred: the customer invoice has been paid in full and delivery has been completed.
Until both conditions are satisfied, the commission is pending and is not yet payable.
If a transaction is later reversed, refunded, charged back, or found to involve fraud, Fire & Ash may offset the affected commission against future amounts otherwise payable to the affiliate.
7. Payouts
Earned commissions are paid by wire within 7 days after the qualifying sale meets the closed-sale requirements above.
Wire approval and processing are handled manually by Fire & Ash management.
Affiliates must provide accurate payment and tax information before payment can be issued. Fire & Ash may delay a payout until required payment or tax documentation has been received.
8. Marketing and brand use
Affiliates may use only Fire & Ash marketing materials, product images, logos, descriptions, and claims that Fire & Ash has approved or made available for affiliate use.
Affiliates may not alter the Fire & Ash brand in a misleading way, make unapproved product claims, promise delivery dates, quote unauthorized pricing, offer discounts without written approval, or represent themselves as an employee or authorized agent of Fire & Ash.
Any public endorsement, testimonial, social post, or promotional content must clearly disclose the affiliate relationship when required by applicable advertising law or platform rules.
Paid search, paid social advertising, domain names, usernames, or ad campaigns using Fire & Ash trademarks require prior written approval.
9. Confidentiality
Affiliates must protect non-public Fire & Ash information received through the program, including pricing not publicly released, customer information, sales information, internal processes, product plans, business strategy, and other information that a reasonable person would understand to be confidential.
Confidential information may be used only for participation in the affiliate program and may not be shared with third parties except as authorized by Fire & Ash or required by law.
These confidentiality obligations continue after an affiliate leaves the program. Information that is already public through no breach by the affiliate is not treated as confidential.
10. Conduct
Affiliates must act professionally and in good faith. Fraudulent referrals, false statements, spam, deceptive marketing, misuse of customer information, impersonation of Fire & Ash, or manipulation of referral tracking are prohibited.
Affiliates may not refer themselves or their own company for commission credit.
Fire & Ash may suspend referral credit, withhold unpaid commissions connected to prohibited conduct, or terminate participation when these rules are violated.
11. Independent relationship
The affiliate is an independent contractor and not an employee, partner, joint venturer, franchisee, or agent of Fire & Ash.
The affiliate has no authority to bind Fire & Ash, negotiate on Fire & Ash's behalf, sign agreements for Fire & Ash, alter pricing, make warranties, or create obligations for the company.
12. Taxes and compliance
Affiliates are responsible for their own federal, state, local, and other taxes arising from affiliate payments.
Fire & Ash may require a completed Form W-9, W-8, or other tax documentation before issuing payment and may report payments as required by law.
Affiliates are responsible for complying with applicable advertising, privacy, anti-spam, consumer-protection, and disclosure requirements when promoting Fire & Ash.
13. Program changes and termination
Either party may end the affiliate relationship at any time, subject to any additional requirements in the signed affiliate agreement.
Fire & Ash may modify program rules, commission rates, approved marketing practices, or operational procedures prospectively. Material changes will be communicated to active affiliates.
Commissions already earned before termination remain payable unless they are connected to fraud, prohibited conduct, a reversal, refund, or chargeback. Future commissions do not accrue after an affiliate leaves or is removed from the program.
14. Records and final decisions
Fire & Ash's CRM, order records, affiliate-code records, invoices, and delivery records are the controlling records for determining referral ownership, sale status, commission amounts, and payout eligibility.
Fire & Ash ownership has final authority over disputes involving referral ownership, existing leads, duplicate referrals, qualification, or interpretation of program rules.
15. Governing law
These program terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute that is not otherwise resolved under the signed affiliate agreement will be handled in the state or federal courts located in Florida, subject to any more specific venue, arbitration, or dispute-resolution provision contained in the final attorney-approved agreement.
